TERMS AND CONDITIONS FOR RESERVATIONS OF NIACE COURSES
These terms apply to all bookings submitted for The National Institute of Adult Continuing
Education (England and Wales) ("NIACE") courses. They may be amended by NIACE from time
to time and, therefore, you should read our current terms and conditions on the NIACE Website
before submitting each booking, or write to NIACE to request a copy of the same.
1 PRICE, AVAILABILITY AND FORMATION OF CONTRACT
1.1 The prices and other information displayed on the NIACE Website or
otherwise are not an offer. Upon receipt of your application for a place on
one of our courses (such applications being referred to in these conditions
as "Reservations") NIACE will e-mail or (if your application has been
submitted by post with no email address given) post an acknowledgement of
receipt to you but this will not constitute an acceptance of your Reservation.
Your Reservation will not be a firm booking unless or until NIACE assesses
your eligibility for the course and confirms your booked place in writing (by
email or post). Places are also subject to availability.
1.2 Whilst NIACE endeavours to ensure accuracy of description and pricing,
there may be occasions where errors arise. In addition to this, prices are
subject to change without prior notice. Should such situations occur NIACE
will contact you with a full explanation and corrected details. NIACE will
allow you the opportunity to cancel your Reservation or booking in such
circumstances.
1.3 NIACE reserves the right to make changes to the published programme of a
course (but not the overall content) e.g. to timings or speakers if one or more
of the advertised speakers is unable to attend. In such case, you will have no
claim against NIACE in respect of such changes, and you will not be entitled
to cancel.
1.4 All prices are payable in Pounds Sterling. Reservations must be made on or
before the closing date for the booking of the relevant course as indicated in
the relevant course information ("the Closing Date"). Only application forms
with the payments section properly completed will be processed.
1.5 You may place your Reservation by completing the application form giving
your details including payment details and (if you are applying via the NIACE
Website) clicking onto the 'authorise' button or (if you are applying by post
or fax) sending your Reservation to us.
1.6 If your Reservation is accepted NIACE will confirm this within 15 days of you
placing your Reservation.
1.7 The Reservation must be placed by the attendee.
1.8 If you do not wish to give your credit card details over the Internet, you can place
your Reservation by fax or by post by printing and completing the application form
and sending it to us together with your credit card details or cheque to reach
NIACE before the Closing Date.
2 PAYMENT
2.1 Those submitting Reservations from outside the UK must pay by credit card or
international banker's draft; VAT is not payable on the prices quoted.
2.2 Please note that NIACE accepts payment by Visa, MasterCard or Switch; other
major credit/debit cards are accepted, however, we do not accept American
Express. NIACE will issue an invoice to organisations where the Reservation fee
payable by the organisation is £35 or more, otherwise it will not issue an invoice.
Non issue of an invoice does not affect NIACE's right to receive payment.
2.3 Those submitting Reservations from inside the UK may pay by credit card or
cheque.
2.4 All Reservations must be accompanied by payment of the relevant booking fee.
2.5 Please ensure that when booking by post you annotate the booking form and the
reverse of the cheque with the event title, date and unique reservation ID number.
3 CANCELLATION BY YOU
3.1 Once your Reservation has been accepted NIACE will commence making
arrangements in respect of it and, therefore, incurring costs. You cannot cancel,
therefore, except as stated on the NIACE Website and at NIACE's discretion.

Website for full details of cancellation terms or write to NIACE.
3.2 There is a limited number of places on each course and these will be allocated in
order of receipt of Reservations. You will be notified in writing within 15 days of
submitting your Reservation if you are placed on a waiting list. PLEASE NOTIFY
NIACE IMMEDIATELY IF YOU DO NOT WISH TO REMAIN ON A WAITING LIST.
3.3 Substitute attendees may be accepted by NIACE provided that the substitute
attendee meets the eligibility criteria for the relevant course.
4 CANCELLATION BY NIACE
4.1 NIACE shall be entitled to cancel your Reservation or booking and/or any course
where it needs to do so due to circumstances outside its control (including but not
limited to the situation where sufficient numbers have not booked for the event or
speakers are unavailable). It will have no liability for losses, costs or expenses you
may incur due to such cancellation but it will refund your Reservation payment to
you or offer you an alternative NIACE course if one is available. You can choose
whether to accept the refund or attend the alternative course.
5 DATA PROTECTION
5.1 The privacy policy on NIACE's website explains how NIACE will use the
information you provide to it. Please write to request a copy of the policy if you do
not have access to the Internet.
6 RIGHTS IN MATERIALS
6.1 All copyright and other rights in materials provided to you during or for the
purposes of any NIACE courses are the property of NIACE or its licensors. You
are entitled to use such materials only for your own personal study. You are not
entitled to copy such materials (except as permitted by law) nor are you entitled to
use or authorise others to use them for any commercial purposes.
7 LIABILITY
7.1 NIACE shall have no liability for loss or damage to any of your personal property
except where this is due to the negligence of NIACE.
7.2 Unless you are a consumer (i.e. someone who is not booking the course in the
course of a business) all conditions, warranties and other terms implied by statute
or common law are, to the fullest extent permitted by law, excluded from any
contract between us.
7.3 NIACE will not be liable for
7.3.1 any indirect or consequential loss suffered by you; or
7.3.2 any loss of profits or loss of business (direct or indirect) suffered by you.
7.4 NIACE's total liability to you in contract, tort (including but not limited to negligence)
or otherwise shall not exceed the relevant booking fee paid or payable by NIACE.
7.5 Nothing in these conditions will exclude or limit NIACE's liability for its fraud nor for
death or personal injury due to its negligence.
7.6 Nothing in these conditions will affect your statutory rights if you are a consumer.
8 ACCOMMODATION
8.1 Where you have booked accommodation with NIACE for the purposes of
participating in a course NIACE shall be entitled to recover from you any
reasonable payment which NIACE makes to the owner/lessor of such
accommodation or any third party for any loss or damage caused by you.
9 LINKS
9.1 NIACE accepts no responsibility for the contents of any sites, which may be linked
to the NIACE Website, and it does not endorse such websites.
10 INFORMATION
10.1 NIACE tries to ensure that the material and information comprised on the NIACE
Website is accurate and up to date but it will have no liability in respect of such
material and information or for its use.
10.2 If your place has been confirmed on a course NIACE aims to send out to you any
pre-course papers, map and directions to the venue a week before the course
date.
11 PUBLICITY
11.1 NIACE may wish to use photographs taken at NIACE courses in publicity, and for
press and publicity purposes (including use on the NIACE website). Your presence
at the course may mean that you are featured in such photographs and you will be
deemed not to object to the taking of such photographs or their use as described
above. If you do not wish to be included in any photograph, please notify the
photographer at the relevant course prior to photographs being taken.
12 JURISDICTION AND LAW
12.1 Contracts between you and NIACE are governed by and shall be construed in
accordance with English law with English courts having jurisdiction subject to any
contrary rights you may have if you are a consumer.
